Abstract:
Separation of three rights' is a major institutional reform to highlight the property value of homestead. From the perspective of development right, this article clarifies the legal basis of homestead development right, and on the basis of analyzing the development process of homestead use control in China, finds that its control mode has the following problems. First, the standardized initial allocation of homestead development right has not been established; Second, the regulation rules of homestead development right need to be optimized; Third, the market of homestead development right has not been established; Fourth, the transfer system of homestead development right has not been formed. Therefore, it puts forward a housing land use control system with the implementation of standardized initial allocation of housing land development rights, the formulation of appropriate rules for housing land use control, the establishment of housing land development rights market, and the construction of housing land development rights transfer system as the core.
